Terms of Service

These Terms of Service ("Terms") govern your use of https://wildkahuna.com (the "Site") and any services provided by Wild Kahuna ("Wild Kahuna," "we," "us," or "our"). By using the Site, requesting an appointment, or purchasing Services, you agree to these Terms. If you do not agree, do not use the Site or Services.
1. Services
Wild Kahuna provides small business websites, scheduling, billing, inventory, lead tracking, automation, and integration services (the "Services"). Specific scope, deliverables, and price for any engagement will be described in a quote, proposal, statement of work, or order that you approve (an "Order"). If an Order conflicts with these Terms, the Order controls for that engagement.
2. Quotes, fees, and payment
- Quotes and estimates are valid for 30 days unless stated otherwise and may change if scope changes.
- Fees are due as set out in the applicable Order (e.g., deposit, milestones, on completion, or recurring).
- Standard payment schedule. Unless an Order states otherwise, project fees are billed on one of the following schedules, which Wild Kahuna selects based on project size and scope and states in the Order:
- Smaller engagements: 50% deposit due up front to begin work, and the remaining 50% due before final handover/delivery.
- Larger engagements: 40% due up front to begin work, 40% due after final review and sign-off, and the remaining 20% due before final handover/delivery.
- Deposits reserve your project and are non-refundable once work has begun, except as required by law or stated in the Order. Final deliverables and handover are provided after the applicable pre-handover payment is received.
- Payments are processed by Stripe. By paying, you agree to Stripe's terms and authorize the charge. Wild Kahuna does not store full card numbers.
- Saved payment methods / automatic billing: if you enroll in automatic or recurring billing, you authorize Wild Kahuna to charge your saved payment method for amounts due on the agreed schedule until you cancel with reasonable advance notice. We will send a receipt for each charge.
- Late or failed payments may pause Services and may incur a late fee or interest to the extent permitted by law.
- Unless required by law or stated in an Order, fees are non-refundable once work has begun.
3. Appointments and bookings
- Appointment requests are not confirmed until we confirm them.
- Cancellation/rescheduling: please give at least 24 hours' notice. No-show or late-cancel fees, if any, will be described at booking.
4. SMS communications
By opting in to SMS communications, you agree to receive text messages from Wild Kahuna regarding services you have requested.
Examples of SMS communications include:
- Verification codes
- Account notifications
- Appointment reminders
- Customer support updates
- Project communications
- Event notifications
Message frequency varies.
Message and data rates may apply.
You may opt out at any time by replying STOP to any message. Reply HELP for assistance.
Your consent to receive SMS messages is not a condition of purchasing products or services.
Wireless carriers are not liable for delayed or undelivered messages.
5. Your responsibilities
- Provide accurate information and timely access, content, and approvals needed for the Services.
- Hold the necessary rights to any content, logos, or materials you provide.
- Use the Site and Services lawfully and not to infringe others' rights or disrupt the Services.
6. Intellectual property
- Your content remains yours. You grant Wild Kahuna a license to use it as needed to perform the Services.
- Deliverables: upon full payment, you receive ownership of the final deliverables created specifically for you, as described in the Order. Wild Kahuna retains rights to its own pre-existing tools, frameworks, templates, and know-how, including reusable platform components, and may reuse them for other clients.
- Wild Kahuna may reference the work and display it in a portfolio unless the Order says otherwise.
7. Third-party services
The Services may rely on third-party providers (e.g., Stripe, Google, hosting, email). Your use of those services is subject to their terms, and we are not responsible for their acts, omissions, or availability.
8. Disclaimers
The Site and Services are provided "as is" and "as available." To the fullest extent permitted by law, Wild Kahuna disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or Services will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the fullest extent permitted by law, Wild Kahuna will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Wild Kahuna's total liability for any claim arising out of the Services will not exceed the amount you paid for the specific Services giving rise to the claim in the 12 months before the claim.
10. Indemnification
You agree to indemnify and hold Wild Kahuna harmless from claims, losses, and expenses arising from your content, your use of the Services, or your violation of these Terms or applicable law.
11. Termination
Either party may terminate an engagement as described in the Order or for material breach not cured within 10 days of notice. You remain responsible for fees for work performed through the termination date.
12. Governing law and disputes
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-laws rules. The parties agree to the exclusive jurisdiction of the state and federal courts located in Missouri, unless an Order specifies arbitration or another venue.
13. Changes to these Terms
We may update these Terms by posting a revised version with a new "Last updated" date. Continued use of the Site or Services after changes means you accept the revised Terms.
